Google Loses National Arbitration Forum Bid for the Rights to Groovle.com

Basically arguing that the Canadian company that owns the domain name Groovle.com is infringing on its trademark rights by confusing customers in the marketplace, Google attempted to domain jack one more domain yet again. However, Google didn't end up in the domain winner's circle, but took it on the chin instead as the National Arbitration Forum did not agree with their core argument that the domain name Groovle.com is substantially similar to the Google trademark.

While there are some in the blogosphere that feel that the arbitrators got this one wrong; I disagree. I agree wholeheartedly with the NAF because Groovle.com is not Groogle.com. If the latter were the case, then I might feel differently about the outcome of this case; however, since it's not the case I don't think Google prevails in this arbitration. It may seem unfathomable that the arbitration board would decide this case based on an one letter distinction, but I agree with this decision. Just because two words look a like does not necessarily mean that marketplace consumers will be confused. After all, Google is Google, and Groovle is well Groovle.

MSNBC Buys Domain Name BreakingNews.com

First MSNBC bought the Twitter handle @BreakingNews, late last month,; however, apparently they weren't done, and are in the process of acquiring the domain namesake, BreakingNews.com, to enhance their competitive advantage in the business of news. According to Rafat Ali, MSNBC is also buying the domain BreakingNews.com, from its current owner, to build its real time news delivery service.

This is the perfect domain for a media outlet, and seems to be an even more natural fit than iReport.com that was purchased by CNN last January from self-proclaimed Domain King, Rick Schwartz, for $750,000. This kind of makes we wonder, how much MSNBC had to shell out for such a highly brandable domain that has an obvious nexus to the media/news vertical; only time will tell.

Live Current Sells Leisure.com for $150,000; Indonesia.com Next

Domain Name Wire is confirming that Domain Marketplace Sedo.com brokered the sale of the internet domain name Leisure.com for Live Current Media. The Domain sold for $150,000, in what is believed to be the first six-figure domain sale of 2010. According to DNW, Live Current is also shopping the domain Indonesia.com.

Sedo Domain Marketplace A Dominant Force In the Domain Sales Arena in 2009

When I discovered the domain industry in 2007, Moniker and Afternic were probably the premiere domain marketplaces. Similar to 2007, in 2008 Moniker and Afternic again appeared to be the top domain dogs when it came to huge domains sales, both in total and on an volume sales scale. However, that all changed in 2009, as online marketplace Sedo seemed to distinguish itself in the most demonstrative manner possible notching 65.5 of the top 100 domain name sales of 2009; nearly 10-times the number of the top sales made by domain marketplace rivals: RickLatona.com; AfternicDLS, and Moniker.com.

Goodwill to Men and Peace on Earth . . . or Out Of the Domain Frying Pan and Into the Domain Fire

Ok, so my headline may be a bit dramatic here, but bear with me. Imagine yourself embroiled in a domain auction for a very strong, generic domain that you win for the tune of $55,000+, only to thereafter find yourself ensnared in the ambit of a dreaded lawsuit. Doesn't sound too pleasant does it? It doesn't whet my palate at all. Nevertheless, this is exactly what happened to Cyber2Media, Inc., according to a report by DomainNameWire.com.

Earlier this month, Cyber2Media, Inc., won the registration rights to the domain Goodwill.com in a hard-fought domain auction at NameJet.com. After winning the auction, and having the domain transferred to them, Cyber2Media, Inc., briefly parked the domain at DomainSponsor, a parking platform owned by Oversee.net. Thereafter the internationally-recognized charitable organization, Goodwill Industries, which appears to have had their eyes on the domain. Goodwill.com, for years filed a lawsuit against the new owners for trademark infringement, unfair competition, violation of the Anti-Cybersquatting Protection Act, and unjust enrichment, among other things.

The lawsuit alleges that Cyber2Media parked the domain Goodwill.com on parking pages that contained advertising links related to charitable giving, which therefore amounted to an infringement of Goodwill Industries' trademark rights.
